Can I refuse a request from my client to give an
undertaking?
Chapter 11 of the solicitors’ code of conduct
makes it clear there is no obligation to give or receive an
undertaking on behalf of a client.
You should also have regard to the CILEx code
of conduct, ensuring that no conflict or significant risk of a
conflict of interest may arise.
If you do not want to give an undertaking
because it is possible that the firm will not be able to comply
with it, you should decline to do so and explain the situation to
your client.
