Is there a requirement to undertake the practice management
courses?
There is no requirement that a person running
a branch office must be qualified to supervise. CILEx
Regulation recommends that a Fellow running a branch office should
give consideration to undertaking the practice management courses
to ensure that their competency to run an office could not be
questioned by the SRA. This would not be necessary if a
member was heading a department within the main office.
There is no absolute restriction against any
member of CILEx heading a department or running a branch office but
the firm must ensure it is complying with Rule 12. If the
member is not suitably experienced or competent, they could be
subject to investigation by the SRA and would also be in breach of
the CILEx Code of Conduct which members to ensure they act within
their competence.
