Accidents on a Highway

"So, you think you know about: Accidents on a Highway"

If you work in personal injury litigation, you will know that injuries and other losses suffered by road users are sometimes due to potholes and other defects in the highway. Local authority lawyers will know that the condition of your council’s roads gives rise to increasing numbers of claims.

Do you know how wide the duty of the local highway authorities is to maintain roads, cycle paths and pavements? Is lack of resources a valid defence? What is the duty of care owed by local authorities when the roads are affected by snow and ice and other winter hazards such as flooding? What is the legal significance of highway authorities not complying with road inspection schedules?

This CPD will help you answer these crucial questions.

Duty of Care

"So, you think you know about: Duty of Care"

During your legal studies you learned about this fundamental aspect of the law of negligence. As a legal professional, you know how important the issue of negligence is to your clients, your firm or organisation and to you as an individual.

But have you kept up with the changes to the approach of the courts to the duty of care? Do you understand the downgrading of the Caparo test to a “formulation”?

This CPD will give you an up-to-date summary of how the law has progressed in this area.

Trespass to Land

"So, you think you know about: Trespass to Land"

If you work in commercial conveyancing, you will know that your land-owning clients will be concerned about trespassers to their land and the damage they may cause. In residential conveyancing, disputes sometimes arise where neighbours have trespassed on each other’s land.

This CPD will focus on the land law aspects of trespass, including wrongful entry, remaining on land and defences.

Trespass to the Person

"So, you think you know about: Trespass to the Person"

If you work in clinical negligence or personal injury litigation this course will be relevant as it reviews the underlying law of trespass to the person, focussing on the torts of assault and battery. Defences, including consent to medical treatment are also covered. The tort of false imprisonment is also discussed and is important for litigators suing the police for the illegal detention of suspects.

This course starts with a short (5 minutes) topic recording which covers the following: the common features of the three torts; the individual elements of battery and assault; the defence of consent; other defences to assault and battery; the individual elements of false imprisonment; and the defence of legally justifiable detention.

We then go into more detail about case law covering trespass to the person, where you will be provided with examples and a scenario and questions to help you reflect on what you have learnt so far.

Lastly, you will be given a real-world example from the news discussing a claim for false imprisonment.

This CPD will give you an up-to-date summary of how the law has progressed in this area.
