Trespass to the Person

If you work in clinical negligence or personal injury litigation this course will be relevant as it reviews the underlying law of trespass to the person, focussing on the torts of assault and battery. Defences, including consent to medical treatment are also covered. The tort of false imprisonment is also discussed and is important for litigators suing the police for the illegal detention of suspects.

This course starts with a short (5 minutes) topic recording which covers the following: the common features of the three torts; the individual elements of battery and assault; the defence of consent; other defences to assault and battery; the individual elements of false imprisonment; and the defence of legally justifiable detention.

We then go into more detail about case law covering trespass to the person, where you will be provided with examples and a scenario and questions to help you reflect on what you have learnt so far.

Lastly, you will be given a real-world example from the news discussing a claim for false imprisonment.
