Proposals misguided – have you say

The Ministry of Justice (MoJ) has set out for consultation proposals to reduce the number and costs associated with whiplash claims. The MoJ proposes the creating of independent medical panels to support better diagnosis of possible whiplash injuries and to raise the threshold for personal injury claims arising from road traffic accidents from £1,000 to £5,000.

CILEx accepts that there are problems with the current system but believe that the Government’s approach is misguided. For example, forcing legitimate claimants into the small claims arena for claims under £5,000, which can be serious injuries, will severely restrict their access to justice and fails to tackle the important issues in the consultation.
