19.08 Civil Procedure Rules- Costs Capping Order

The Ministry of Justice (MoJ) has set out for consultation proposals to amend Part 44 of the Civil Procedure Rules 1998 by inserting new rules in relation to Costs Capping Orders (CCOs).

The consultation also proposes amendments to the Costs Practice Direction to provide guidance to costs capping. In summary, CCOs gives the court the power to limit parties’ recoverable costs at different stages litigation. The proposals are drawn from current case law and so do not propose new policy.

The consultation has a short timeframe for responses and closes on the 24 October 2008.
