Mazur: Member update from CILEX CEO

As promised, I’m writing to keep you informed about the steps we’re taking – and the progress we’re making – to support our members in the aftermath of Mazur.

This is the first in a series of regular updates, designed to keep you in the loop as developments unfold and to share new information as soon as it’s available.

Here’s what’s happening right now:

Securing routes to practice rights: We’re working closely with our independent regulator, CILEX Regulation Ltd (CRL), to help make sure those who need practice rights can get them quickly and efficiently. As a reminder, it’s CRL’s responsibility to award members with practice rights. To help us shape our next steps we need your input, so if you’re a Fellow considering obtaining practice rights and haven’t yet completed our short survey, please take a few minutes to complete it by the end of today. Complete survey here.

CRL is currently exploring various solutions including offering additional assessment sessions through the ULaw route, the scope for efficiencies with all authorisation routes, and providing additional guidance to members. Decoupling of Litigation and Advocacy Rights: Decoupling of Litigation and Advocacy Rights: An application has been submitted by CRL and is being considered by the Legal Services Board (LSB). We have stressed to the LSB the importance of a quick outcome. CRL has also confirmed “you can submit an application under the current litigation and advocacy route and inform CRL that you want the application to be considered under the standalone litigation route (subject to LSB approval). Your application will then be automatically considered under the new standalone route.” Please refer to CRL’s Mazur information hub which provides more detailed updates and FAQs.

Influencing stakeholders at the highest level: We’re actively engaging with key decision-makers across the profession to raise awareness of the impact of Mazur on our members, alongside the short- and long-term impact on the legal system and diversity of the legal sector.

Although last week’s meeting with the LSB and regulators did not produce definitive resolutions, we continue to pursue progress. This includes raising CILEX members’ issues with Deputy PM David Lammy, Baroness Sue Carr and Andrew McFarlane (judiciary), Richard Orpin (LSB Chief Executive), the Solicitor General and Ministry of Justice officials, to explore proactive action that could be taken to improve the situation.

Advocating for changes to legislation: We’re also working with the Ministry of Justice, LSB, regulators, lawyers and professional bodies to explore both an immediate fix to keep current cases progressing through the courts and a lasting, legislative solution.
