CILEx response to the Ministry of Justice consultation on no-fault divorce.
As family law principles evolve to promote a conciliatory approach, it stands to reason that a divorce process predicated on finding fault is no longer fit for purpose. CILEx nonetheless recognises the need for this process to have a requisite level of formality to ensure that it does not lose its significance nor open the system up to abuse.
